Terms of service

Last updated 7 October 2026.

1. Introduction

These Terms of Service (“Terms”) govern your use of the Placestack website, console, Explorer, API and MCP server (the “Service”), provided by Placestack, Inc. (“Placestack”, “we”, “us”). “Data” means any information the Service returns to you.

2. Acceptance of terms

By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind it, and “you” includes that organization. You must be at least 18 years old to use the Service.

3. Accounts

You must provide accurate information when you create an account and keep it current. You are responsible for all activity under your account and API keys, and for keeping your credentials confidential. Notify us promptly of any unauthorized use. An Explorer seat may be used by one person only.

4. Fees and payment

Fees, credit rates and plan terms are listed on the pricing page or in your order form. Subscriptions renew automatically each month and are charged in advance until you cancel in the console. Cancellation takes effect at the end of the current billing period.

Credits have no cash value, are not transferable and expire as stated on the pricing page. All fees are non-refundable except where required by law. Fees do not include taxes, which you are responsible for paying. We may change our fees. A change to a subscription fee takes effect at your next renewal.

5. License and restrictions

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Service and use the Data in your internal business operations and as part of applications you offer to your own customers.

Unless we agree otherwise in writing, you may not:

  • Sell, resell, license, distribute or publish the Data, or any substantial portion of it, as a dataset or standalone product.
  • Use the Data or the Service to build or improve a product that competes with Placestack.
  • Bulk download, scrape, cache or store the Data beyond what your application reasonably requires.
  • Use the Data to train, fine-tune or improve an AI model that is offered to third parties, or in a way that lets an AI model reproduce a substantial portion of the Data.
  • Copy, modify, reverse engineer or create derivative works of the Service, or remove any proprietary notices.
  • Share your account, seats or API keys with others.

6. Ownership

Placestack and its licensors own all rights in the Service and the Data, including our compilation, normalization and structure of public records. Except for the license in section 5, these Terms grant you no rights in the Service or the Data.

7. Feedback and publicity

If you send us feedback or suggestions, we may use them without restriction or obligation to you. We may identify you as a customer by name and logo unless you ask us not to.

8. User conduct

You may not use the Service to:

  • Violate any law or the rights of others.
  • Circumvent rate limits, usage limits, fees or security measures.
  • Interfere with, disrupt or attempt unauthorized access to the Service or its systems.
  • Make decisions about a person’s eligibility for credit, employment, insurance or housing.

You represent that you are not located in, or a resident of, a country subject to US embargo, and are not on any US government list of prohibited or restricted parties.

9. Changes to the Service

We may change, suspend or discontinue any part of the Service at any time. Unless we agree otherwise in a signed agreement, we have no obligation to provide support, maintenance or any level of availability.

10. Data accuracy and assumption of risk

The Data is compiled from public records and third-party sources that may be incomplete, outdated or inaccurate. Responses from the AI assistant may also be inaccurate. The Data is not legal, survey, title, appraisal or other professional advice. You are solely responsible for independently verifying the Data before relying on it, and you assume all risk of your use of it.

11. Disclaimers

THE SERVICE AND THE DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, PLACESTACK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS AND TIMELINESS. PLACESTACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLACESTACK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THE DATA, EVEN IF ADVISED OF THEIR POSSIBILITY. PLACESTACK’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO PLACESTACK IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You will defend, indemnify and hold harmless Placestack and its officers, directors, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising from your use of the Service or the Data, your applications, or your breach of these Terms or any law.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service and close your account at any time. On termination, your license ends, and you must stop using and delete the Data. Sections 4 through 7 and 10 through 17, and any fees owed, survive termination.

15. Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. The state and federal courts located in Wake County, North Carolina have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to their jurisdiction. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class or representative action. To the extent permitted by law, each party waives the right to a jury trial.

16. Changes to these Terms

We may revise these Terms at any time by posting the updated Terms on this page and changing the date above. Your continued use of the Service after a revision means you accept it.

17. General

These Terms, together with our privacy policy and any order form you sign with us, are the entire agreement between you and Placestack about the Service. If a signed order form conflicts with these Terms, the order form controls for the services it covers. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them without restriction. We are not liable for any delay or failure caused by events beyond our reasonable control. You consent to receive notices and communications from us electronically.
